In these Terms and Conditions we refer to the person who accesses this Website as either “you” or “your”, as the context may require.

Your access to and use of this Website is conditional on your acceptance of these Terms and Conditions. If you do not accept these Terms and Conditions then you must not access or use or must immediately cease all access or use of this website.

The terms “we”, “us” and “our” used below refer to It Takes a Village.

We, It Takes a Village, reserve the right to review and amend any of these Terms at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms will take effect immediately from the date of publication.

In addition, the Privacy Policy applies to your use of the Website.

Creating a Village for yourself

When you create a Village for yourself and tick the box that says ‘I understand and accept the Terms and Conditions’, you become legally bound by these terms and conditions and our Privacy Policy.

Creating a Village for someone else

You warrant that you are authorised to provide us with that personal information and that we are able to use that personal information for the purposes as set out in our privacy policy. This would include, for example, using their email address to undertake delivery of their Village.

Receiving a Village created by someone else

When you receive a Village, created for you, by someone else, and tick the box that says ‘I understand and accept the Terms and Conditions’, you become legally bound by these terms and conditions and our Privacy Policy.

Redeeming It Takes a Village credit

It Takes a Village credit is redeemed through the use of individual promotional codes on our partners’
websites. Any purchases made through our partners’ websites will be bound by their terms of sale.

Guarantees and Warranties required by law

Except as set out under Australian Consumer Law It Takes a Village credit is non-refundable. You have rights under Australian Consumer Law in respect of guarantees and warranties for our products and services which by law cannot be excluded.

If you have any issues with a product or service purchased from an external supplier with It Takes a Village credit you will need to raise a claim with the supplier of that product or service. If you are unable to resolve your issue, we will provide you a remedy in accordance with your statutory consumer guarantee rights and these terms and conditions.

In particular:

In respect of products purchased they must be of acceptable quality, free from defects, match what was advertised and be reasonably fit for the purpose considering the prices and description provided to you at the point of sale. If there is a major failure with the product not fulfilling any of these criteria then you will be entitled to a refund in accordance with your statutory consumer guarantee rights so long as the complaint is made to us within a reasonable period of time.

In respect of services you will be entitled to a refund in accordance with your statutory consumer guarantee rights if there is a major failure with supplier not providing the service with due skill and care, not providing the service within a reasonable period of time within the validity period, or with the service not being fit for the purpose described at the point of sale.

Please note that refunds can only be processed back to the original purchaser.

Unless otherwise agreed, refunds will be provided as It Takes a Village credit.

Payments

All payments and associated data is managed through a partnership with Stripe. Stripe is responsible for providing its Services in a manner that is consistent with Industry highest certification level (known as PCI Level 1) provided by the PCI-DSS requirements. Stripe’s PCI certification is confirmed annually by a qualified security assessor to ensure compliance.

Stripe respects the privacy of everyone that engages with their services and are committed to being transparent about privacy processes and policies. Their platform enables millions of businesses, and in order to provide products and services to their Users, they collect and process Personal Data. The Data Processing Agreement (DPA) governs how Stripe and Users treat Personal Data. The DPA is incorporated into the core terms of the SSA and can be found here

Prices

We reserve the right to change prices without notice. Where applicable, all prices include Goods and Services Tax (GST) at the current rate of 10% in Australia.

A $2.50AUD service fee will apply each time you start or contribute to a Village on the It Takes A Village website.

A transaction fee may apply for the use of the Stripe Payment Gateway, and where this is the case this will also be described on the website.

E-mails

It Takes A Village is not liable or responsible for any loss suffered as a result of transactional information sent via email being blocked by filters or firewalls, or where the incorrect email address has been entered by the purchaser. If the recipient does not receive a transactional e-mail (including e-mails in respect of promotional codes or It Takes a Village credit) , please contact us immediately to send the relevant information to an alternative email address.

It Takes a Village Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that under law cannot be excluded, modified or restricted such as your statutory consumer guarantee rights, including under the Australian Consumer Law.

Subject to such legislation, It Takes A Village has:

No liability for any act, omission or default, whether negligent or otherwise of any experience provider or third party.

No liability for any loss or damage occasioned by any negligent act or omission of any experience provider or third party.

Where It Takes a Village liability cannot be excluded, such liability is limited to the value of the It Takes a Village credit purchased.

Other Information

The text and illustrations (including photographs) used by It Takes A Village are protected by copyright and must not be copied in whole or in part with the express permission of It Takes a Village.

Limitations of Use

By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

• modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website;

• remove any copyright or other proprietary notations from any materials and software on this website;

• transfer the materials to another person or “mirror” the materials on any other server;

• knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service It Takes a Villaeg provides;

Information security

Notwithstanding the reasonable steps taken to keep information secure, breaches may occur. In the event of a security incident we have in place procedures to promptly investigate the incident and determine if there has been a data breach involving personal information, and if so, to assess if it is a breach that would require notification. If it is, we will notify affected parties in accordance with Privacy Act requirements.

In the event of a security incident involving unauthorised access, use or disclosure of personal information where a third party with whom we share personal information is involved, we will seek to work cooperatively with them to protect the personal information we have shared with them.
